Puppy Purchase contract

His and Hers Poodles and Doodles Puppy Purchase Contract

This agreement is between His and Hers Poodles and Doodles (Seller) and 

_________________________________________ (Buyer) It is agreed between Seller and Buyer as follows: 

Seller will provide puppies that have been examined by a veterinarian and are up to date on required vaccinations at time of transfer. The buyer will be provided with all medical and vaccination records for the puppy while in the care of the seller. Puppies will stay with the seller until at least 8 weeks of age, until it can be weaned from the mother. 

All puppies will be registered with either the AKC or CKC depending on the breed you purchase. All miniature poodle puppies will come with AKC registration and paperwork. AussieDoodle puppies are a designer breed (Australian Shephard and Poodle) therefore cannot be registered with a purebred kennel club such as AKC but will be registered with CKC registration which accepts designer breeds. 

Our puppies are sold as pets only, unless breeding rights are purchased at an additional $500. To receive our pet pricing you agree to spay or neuter the puppy between 6-12 months of age and submit written proof. 

The buyer agrees to provide the puppy with regular veterinarian care, including vaccines, annual check-ups and de-worming due at the buyers veterinarian’s recommendations. All expenses incurred after the puppy leaves the sellers premises are strictly the responsibility of the buyer. Seller assumes no responsibility for medical expenses, landlord disapprovals, allergies to animals, or any other reason not stated.

Although poodles and doodles are considered hypo-allergenic the seller does not guarantee puppies to be completely non-shedding or allergy friendly. The seller does not guarantee color, size, fertility, or temperament of any puppy. 

The seller reserves the right to hold back a pick of litter for their breeding program and the right to decline selling to anyone they feel might not be a good fit for one of their puppies if a sale has not yet been finalized. 

Buying a puppy is a lifetime commitment. The buyer promises to keep the dog in a proper manner. It shall not be kept permanently in a kennel or outdoors. The buyer agrees to never place this puppy into a shelter for unwanted animals but will guarantee this puppy will be placed into a loving home if a situation arises where you will be unable to care for it. If the buyer needs assistance in re-homing their puppy, please contact the seller to discuss the situation to find the best solution for the puppy.

Health Warranty

The seller does NOT guarantee against common illnesses such as Coccidia, Giardia, Worms, Kennel Cough, or hernias. The seller DOES offer one year guarantee against any life-threatening genetic defects. To utilize the life-threatening genetic defect warranty, the puppy must be examined by the buyers veterinarian to check for life-threatening genetic defects within 3 business days of the date of possession. This life-threatening genetic warranty is valid only to the buyer named in this contract.
 

If the puppy that was purchased should have a life-threatening genetic defect, the buyer will replace the puppy with another puppy of the same or lesser value. To redeem, the following must be provided: 

• A letter from the buyers original veterinarian that the puppy was seen within 3 business days of taking possession.
• A letter from a licensed veterinarian describing the life-threatening genetic defect. 
• All medical records and documentation from the buyer’s veterinarian to show that the puppy was seen regularly for required vaccinations and annual examinations. The buyer will also provide medical documentation of any procedures or surgeries that were performed on the puppy while in the buyers care. 
• The original puppy must be provided to the seller within 7 days of the life-threatening defect diagnosis. 

Buyer acknowledges that if the buyer proceeds with medical treatment from his/her veterinarian for the life-threatening genetic defect instead of returning the puppy to the seller within 7 days of diagnosis, then this guarantee is null and void. 

All sales are final and non-refundable, but the buyer may receive a replacement puppy at no cost if terms are met as outlined in the health warranty. ​ 

Full and Final Agreement The parties agree that this writing represents the entire Agreement between them and that no other representations, either oral or written, have been made regarding the dog described above. The parties further agree that no changes in this contract shall be binding upon either of them without written modifications signed by both parties. Buyer agrees that he/she understands this contract fully, and that this contract is under the jurisdiction of the State of North Carolina.
